While you should always contact your insurance company, collect evidence, and seek medical attention following any type of car accident, there are also a handful of things you should avoid doing. By making an effort to not give into your impulses and frustrations following a car wreck, you will be staying in line with the law. Many people don’t think about this, but your actions after a car accident could result in being charged with a misdemeanor or even felony, which could land you in jail.

With that in mind, let’s go over 5 things you should avoid doing following a car accident in DFW:

• Never apologize to the other driver. This may go against your instincts, but never tell another driver you are sorry for an accident. Apologizing is often viewed as an admittance of guilt, which can cause major problems should your case go to court. Furthermore, saying “I’m sorry” can also hurt your insurance claim. Even saying something like, “I wasn’t paying attention” can be held against you as an admission of guilt.
• Never leave the scene of an accident. According to Texas law, anyone who has been involved in an accident that results in injury to another person, death, or property damage must stop their vehicle and remain at the scene until authorities arrive. If you do not do this and leave the scene, you could face criminal charges.
• Do not forget to document the scene of an accident. Documenting the scene of an accident is one of the most crucial parts of an investigation. Use your smartphone, tablet, or camera to document the scene, including damage to any cars, injuries to individuals, and the surrounding environment. Take as many pictures as you can and jot down everything you see. It is also a good idea to talk to witnesses and take down their information.
• Do not forget to exchange information with the other driver. One of the first things you should do following an accident is exchanging information with all other involved drivers. Get their name, address, phone number, license plate number, and the name of his or her insurance company.
• Never speak with the other driver’s insurance company. If the other driver is to blame for the accident, make sure you do NOT talk to his or her insurance company. Insurance companies are often fish for information and try to get the other driver to say something that may hold them accountable.
